Successful Settlement for Davis McGrath Contractor Client in Mechanics Lien Case
Davis McGrath, LLC recently obtained a successful settlement for one of its contractor clients in a mechanics lien case filed in the Cook County Chancery Division.
The firm’s client, a commercial fuel distributor, supplied fuel to a demolition contractor on a large industrial project near Evanston Illinois. When the contractor failed to pay, The firm filed a mechanics lien on the property and then sued to foreclose the lien and to recover under a payment bond from the bonding company.
After about a year of litigation, the firm secured a settlement for its subcontractor client of nearly 94% of its total claim – with half of the payment coming from the property owner and the other half coming from the bonding company.
Considering that mechanics lien litigation involving multiple parties (like this case) often lasts over 2 years and a subcontractor’s lien claim is often wiped out by prior recorded liens, this was an excellent result for the firm’s client.
